In this privacy policy, we, Bern Congress Organiser GmbH (hereinafter referred to as BCO, we or us), explain how we collect and process personal data. This is not an exhaustive description; other data protection declarations or general terms and conditions, conditions of participation and similar documents may regulate specific matters. Personal data refers to all information relating to an identified or identifiable person.

If you provide us with personal data of other persons (e.g. family members, data of work colleagues), pleaseensure that these persons are aware of this privacy policy and only share their personal data with us if you are permitted to do so and if this personal data is correct.

This Privacy Policy is designed to meet the requirements of the EU General Data Protection Regulation ("GDPR"), the Swiss Data Protection Act ( "DSG" ) and the revised Swiss Data Protection Act ("revDSG").However, whether and to what extent these laws are applicable depends on the individual case.

2. Collection and processing of personal data

We primarily process the personal data that we receive from our customers and other business partners as part of our business relationship with them and other persons involved or that we collect from their users when operating our websites, apps and other applications.

Data in connection with the use of the websiteThe provider of the pages automatically collects and stores information in so-called server log files, whichyour browser automatically transmits to us.

  • your IP address (in some circumstances)
  • the version of your browser software

3. Purposes of data processing and legal basis

We primarily use the personal data we collect to conclude and process our contracts with our customers and business partners, in particular as part of our core business with our customers and the purchase of productsand services from our suppliers and subcontractors. The core business of a PCO (Professional Conference Organizer) comprises the planning, organization and implementation of events such as conferences, meetings, trade fairs and events.

If you work for such a customer or business partner, you may of course also be affected in this function with your personal data. In addition, we also process personal data of you and other persons for the following purposes, where permitted and where we deem it appropriate, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:

  • Offering and further developing our products, services and websites, apps and other platforms on which we are present;
  • Communication with third parties and processing their requests (e.g. applications, media inquiries);
  • Examination and optimization of procedures for needs analysis for the purpose of direct customer contact and collection of personal data from publicly accessible sources for the purpose of customer acquisition;
  • Advertising and marketing (including the organization of events), provided you have not objected to the use of your data (if we send you advertising as an existing customer, you can object to this at any time and we will put you on a blacklist against further advertising mailings);
  • Media monitoring;
  • Assertion of legal claims and defense in connection with legal disputes and official proceedings;
  • Prevention and investigation of criminal offenses and other misconduct (e.g. conducting internal investigations, data analysis to combat fraud);
  • Guarantees of our operations, in particular IT, our websites, apps and other platforms;
  • Other measures for IT, building and facility security and protection of our employees and otherpersons and assets belonging to or entrusted to us (e.g. access controls, visitor lists, network and mail scanners, telephone recordings);
  • Purchase and sale of business divisions, companies or parts of companies and other transactions under company law and the associated transfer of personal data as well asmeasures for business management and compliance with legal and regulatory obligations and BCO's internal regulations

If you have given us your consent to process your personal data for specific purposes (for example, when you register to receive newsletters), we will process your personal data within the scope of and based onthis consent, unless we have another legal basis and require one. Consent that has been given can be withdrawn at any time, but this has no effect on data processing that has already taken place.

Information, deletion and correction
You can request information about your data stored by us at any time. To do so, please send us a request for information by e-mail. Together with the request, proof of identity must be sent to the same address. Youhave the option of requesting the deletion or correction of your data at any time. You are of course also entitled to withdraw your consent to the use or processing of personal data at any time with effect for the future. All you need to do is send us an informal message by e-mail. Stored data will be deleted by us if it is no longer required for the stated purpose.

4. Cookies / tracking and other technologies in connection with the use of our website

Our website is networked with third-party functions and systems in a variety of ways. In the following, wedescribe the services that process personal data collected on our behalf on the website and provide information about data processing within our own infrastructure.

SSL- or TLS-encryption

For security reasons and for the protection of the transfer of confidential content such as, for example, orders or requests you send us as the website operator, this page uses SSL or TLS encryption. You can recognise an encrypted link by the fact that the browser’s address line changes from “http://” to “https://” and by the padlock symbol in your browser line.

If SSL or TLS encryption is activated, the data you send us cannot also be read by third parties.

Embedded content from other websites

Items on this website may contain embedded content (e.g. videos, pictures, contributions etc.). Embedded content from other websites behaves exactly as if the visitor had visited the other website such as, for example:

  • Google Maps
  • YouTube or Vimeo videos
  • Web fonts from fonts.com
  • Newsletters from MailChimp
  • Evaluation of visitor numbers using Google Analytics

These websites can collect data about you, use cookies, embed additional third-party tracking services and record your interaction with that embedded content if you have an account and are registered on that website.

Cookies

Cookies are technical aids for the above data collection by third-party providers. The BCO website also applies cookies to enable you to use the technical functions such as, for example, contact forms. Cookies are harmless text files that your browser stores on your computer automatically if you visit our internet page. They enable the identification of a visitor within a predefined timespan.
Most internet browsers accept cookies automatically. However, you can at any time configure your browser in such a way that no cookies are stored on your computer. Our website can essentially be used without accepting cookies, although in that case the website’s functionality is significantly restricted.

Google Analytics

For the evaluation of visitor numbers, we use the Google-Analytics service with an IP anonymisation function on our website. In that case your IP address is abbreviated by Google and thereby anonymised, as a result of which it can no longer be traced back to a particular visitor.

If you have registered with the service provider yourself, the service provider also knows you. Theprocessing of your personal data by the service provider is then the responsibility of the service provider in accordance with its data protection provisions.

YouTube

Our webpage contains at least one YouTube plugin. As soon as you visit one of our pages with a YouTube plugin, a link is created to the YouTube servers. This tells the YouTube server which page you visited. Should you additionally be logged onto your YouTube account, you would enable YouTube to link the surfing behaviour directly to your personal

profile. You can deactivate this possibility of linking if you log out of your account in advance. For further information on the collection and use of your data by YouTube, see the data protection information under: http://www.youtube.com/t/privacy.

Vimeo

For the incorporation of videos we use the provider Vimeo. On some of our webpages we use Vimeo plugins. Should you view any of our webpages equipped with such a plugin, a link is created to the Vimeo servers and the plugin thereby accessed. As a result, a message is sent to the Vimeo servers showing which of our webpages you visited. If, at the same time, you are logged in as a member of Vimeo, Vimeo links this information to your personal user account. When using this plugin such as, for example, clicking on the start button of a video, this information is again linked to your user account. You can prevent this link being made if you log off your Vimeo user account before using our webpage and delete the relevant Vimeo cookies. Matomo

In addition, we use the Matomo tracking system (formerly PiWiK) to evaluate visitor figures, which is run on our own system. This data collection assists us in the operation and improvement of our services. The capture of your data is anonymised, as a result of which it can no longer be traced back to a particular visitor.

You can decide here whether an obvious web-analysis cookie may be stored in your browser to enable the operator to collect and analyse different items of statistical data. Should you wish to opt out of this, click the Matomo deactivation cookie in your browser.

reCaptcha

The BCO website forms are protected against unauthorised transfer by robots through Google reCaptcha v3. It is technically unavoidable that a number of items of personal data relating to your user behaviour are for this purpose transferred to Google in order to identify you as a person. Google has undertaken to ensure a reasonable level of data protection. For that reason, every form has a notice to that effect (“protected by reCaptcha”) with a link placed to the Google operator’s data protection policy. Web fonts

Incorporated on this website is a myfonts.com web font. Given the provider’s licensing regulations, we are obliged to incorporate a mechanism for counting interactions with our website which also entails sending your IP address. Contact forms

You can contact us using forms on this website, the content of which is sent to us by e- mail. Certain personal information is required before your request can be processed and responded to (name, first name and mail address) although we keep the data collected to a minimum. This information is only stored in relation to your request and is not used for other purposes (for example, e-mail marketing) without your express consent.

Registration on this website

You can register on our website in order to use additional functions on the site. We only use the data input for that purpose in relation to the use of the relevant offer or service for which you registered. The mandatory information requested during registration must be provided in full. Otherwise, we will refuse registration.

For key changes such as to the scope of an offer or in the case of changes required for technical reasons, we use the e-mail address provided when you registered to inform you in this way.

Processing of the data input upon registration is done on the basis of your consent. You may at any time revoke any consent given by you. An e-mail message sent to us – in whatever form – is sufficient for that purpose.

The data acquired upon registration is stored by us for as long as you are registered on our website and is then erased.

Data transfer when contracts are entered into for online shops etc.

We send personal data to third parties only if this is necessary as part of contractual performance, for example to the company responsible for delivering the goods or the credit institution engaged to process payment. No further transfer of the data occurs, or it does so only if you have expressly consented to such transfer. Your data is not passed on to third parties for advertising purposes, for example, without your express consent.

Newsletter

We offer you the option of our newsletter, so you can find out at regular intervals about our offers and developments in our sector. We do not register you for our newsletter for marketing purposes without your express agreement. Customers receive our newsletter automatically to keep you informed, as part of contractual performance, about changes to this data protection policy, for example.

You may unsubscribe from our newsletter at any time. Write and let us know which address should be cancelled.

To send our newsletter we use the online service MailChimp. To receive the newsletter a valid mail address is required. This is sent to MailChimp when you register, along with your title, first name and surname and your IP address. Newsletters also capture information specific to the individual, whether a newsletter has been opened and which links in it have been clicked on. This data allows us to review the quality of and make improvements to our newsletter.

Following registration MailChimp sends you an e-mail confirming your subscription. In addition, MailChimp offers various options for analysing how the sent newsletters are opened and used, e.g. how many users an e-mail was sent to, whether e-mails were returned and whether users unsubscribed from the list following receipt of an e-mail. These analyses are only done in relation to groups, however, and are not used by us to assess individuals. MailChimp additionally uses Google, Inc’s analysis tool Google Analytics and in some circumstances incorporates this into the newsletter. We also use so-called plug-ins from social networks such as Facebook, Twitter, YouTube, Pinterest or Instagram on our websites. This is visible to you in each case (typically via corresponding icons). We have configured these elements so that they are deactivated by default. If you activate them (by clicking on them),the operators of the respective social networks can register that you are on our website and where and canuse this information for their purposes. The processing of your personal data is then the responsibility of this operator in accordance with its data protection provisions. We do not receive any information about you from them.

5. Data transfer and data transmission abroad

Within the scope of our business activities and purposes, we also disclose data to third parties to the extent permitted and deemed appropriate, either because they process it for us or because they wish to use it fortheir own purposes. This applies in particular to the following parties:

  • Service providers of ours (within BCO and externally, such as banks, insurance companies),including contract processors (such as IT providers);
  • Dealers, suppliers, subcontractors and other business partners;
  • Customers;
  • domestic and foreign authorities, official bodies or courts;
  • Media;
  • the public, including visitors to websites and social media;
  • Competitors, industry organizations, associations, organizations and other bodies;
  • Acquirers or parties interested in acquiring business divisions, companies or other parts
  • other parties in potential or actual legal proceedings;

Some of these recipients are in Germany, but they can be anywhere in the world. In particular, you must expect your data to be transferred to all countries where the service providers we use are located (e.g. Microsoft, MailChimp).

6. Duration of storage of personal data

We process and store your personal data for as long as is necessary for the fulfillment of our contractual and legal obligations or otherwise for the purposes pursued with the processing, i.e. for the duration of the entire business relationship (from the initiation, execution to the termination of a contract) as well as beyondthat in accordance with the statutory retention and documentation obligations. It is possible that personal data may be stored for the period in which claims can be asserted against our company and insofar as weare otherwise legally obliged to do so or legitimate business interests require this (e.g. for evidence anddocumentation purposes). As soon as your personal data is no longer required for the above- mentioned purposes, it will be deleted or anonymized as far as possible.

7. Obligation to provide personal data

As part of our business relationship, you must provide the personal data that is necessary for the establishment and execution of a business relationship and the fulfillment of the associated contractualobligations (as a rule, you do not have a legal obligation to provide us with data). Without this data, we will generally not be able to conclude or execute a contract with you (or the entity or person you represent). The website can also not be used if certain information to secure data traffic (such as IP address) is not disclosed.

8. Rights of the data subject

You have the right to information, correction, deletion, the right to restrict data processing and otherwise to object to our data processing within the scope of the data protection law applicable to you and to the extent provided for therein (such as in the case of the GDPR). Please note, however, that we reserve the right to assert the restrictions provided for by law, for example if we are obliged to store or process certain data,have an overriding interest in doing so (insofar as we may invoke this) or need it to assert claims.

We have already explained the possibility of withdrawing your consent in Section 0 above. Please note that exercising these rights may conflict with contractual agreements and may have consequences such as premature termination of the contract or cost consequences.

The exercise of such rights generally requires that you clearly prove your identity (e.g. by means of a copy of your identity card, where your identity is otherwise not clear or cannot be verified). To assert your rights, you can contact us.

9. Data security

We protect your personal data using the usual organizational and technical security measures. We review these measures on an ongoing basis and amend them if necessary to mitigate potential risks and prevent unauthorized use. However, we cannot guarantee that data will not be lost, misused or altered. In such cases, we take the measures required by law and inform those affected and the authorities immediately and transparently.

10. Changes to the data protection provisions

Due to the further development of the legal framework and due to technological progress, it may becomenecessary to amend these data protection provisions. You can access the current data protection provisions at any time on our website.
